10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

You agree that any legal action or proceeding between TrendTested and you for any purpose concerning these Terms or the parties’ obligations hereunder shall be brought exclusively in a federal or state court of competent jurisdiction sitting in the United States.

11. Arbitration Agreement

You agree that any dispute arising out of or relating to these Terms or the Site will be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, rather than in court, except that you may assert claims in small claims court if your claims qualify.

The arbitration will be conducted in the United States, and judgment on the arbitration award may be entered into any court having jurisdiction thereof. Either you or TrendTested may seek any interim or preliminary relief from a court of competent jurisdiction as necessary to protect the rights or property of you or TrendTested pending the completion of arbitration.

12. Termination

We may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Site will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. The failure of TrendTested to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

These Terms, along with our Privacy Policy, Cookie Policy, and Affiliate Disclosure, constitute the sole and entire agreement between you and TrendTested regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.
